How to Register a Trademark in Japan — Complete Step-by-Step Guide
A detailed 7-step walkthrough of the Japanese trademark registration process, from initial search through JPO examination to final registration.
Step 1: Trademark Search
Before filing, search the J-PlatPat database to check whether identical or similar trademarks already exist in the same Nice classes. A thorough prior-art search dramatically reduces the risk of refusal and wasted filing fees. You can also use Shohyo Navi's AI search tool for a quick similarity check.
Step 2: Choose Classes
Japan uses the Nice International Classification system with 45 classes — Classes 1–34 for goods and 35–45 for services. You must designate at least one class on your application. Choosing the wrong class means your mark will not be protected for the products or services you actually offer.
Step 3: Prepare Application
The application form requires the trademark itself, the designated goods/services (in Japanese), and the applicant's details. The description of designated goods and services is critical — if it is too narrow your protection is limited, and if it is incorrect the JPO will issue a refusal.
Step 4: File Application
Submit your application to the JPO either online via the electronic filing system (INPIT) or by paper. Electronic filing is cheaper and faster. The filing fee is ¥3,400 plus ¥8,600 per class. Foreign applicants without a Japanese address must appoint a local patent attorney as their representative.
Step 5: Examination
After filing, the JPO conducts a formality examination followed by a substantive examination. The standard examination period is approximately 6–12 months. If you need faster results, Japan offers an accelerated examination (早期審査) that can shorten the timeline to 2–3 months under certain conditions.
Step 6: Decision
If the trademark meets all requirements, the JPO issues a registration decision (登録査定). If issues are found, a notice of refusal (拒絶理由通知) is sent, and you have 40 days to respond with arguments or amendments. Many refusals can be overcome with a well-crafted response.
Step 7: Pay Registration Fee
Within 30 days of the registration decision, you must pay the registration fee. The fee is ¥16,400 per class for a full 10-year term, or ¥8,600 per class for a 5-year split payment. Once paid, your trademark is officially registered and published in the Trademark Gazette.
